Terms of Service

These terms govern your use of the The Fittest Diabetic website, the Playbook, the newsletter, the app waitlist, and any related content (together, the "Service"). By using the Service or signing up, you agree to these terms.
1. Who we are
The Service is operated by Sam Chadwick, based in Christchurch, New Zealand ("we", "us"). Contact: sam@thefittestdiabetic.com.
2. What the Service is
The Service provides general education, information, and lived experience about exercising with Type 1 diabetes, plus content and updates you sign up to receive. It is for informational and educational purposes only.
3. Eligibility
The Service is intended for adults. If you are under 16, please use it only with the involvement of a parent or guardian.
4. Acceptable use
You agree to use the Service lawfully and not to misuse it — for example, by attempting to disrupt it, access it without authorisation, or use it to harm others.
5. Our content
The content we create — including the Playbook, written material, graphics, and brand — belongs to The Fittest Diabetic and is protected by intellectual property laws. You may read, download, and share our content for your own personal, non-commercial use, and we're glad when you share the Playbook with someone who'd benefit. You may not resell it, or reproduce it commercially, without our written permission.
6. Emails and communications
When you sign up, you're consenting to receive the emails you asked for. You can unsubscribe at any time using the link in every email. How we handle your information is set out in our Privacy Policy.
7. Third-party links and services
The Service may link to third-party websites or use third-party providers (such as our email and hosting providers). We're not responsible for the content or practices of third parties.
8. No warranties
The Service is provided "as is" and "as available". To the extent permitted by law, we make no warranties that it will be accurate, uninterrupted, error-free, or suitable for your particular situation. Any decisions you make based on the Service are your own responsibility, made in consultation with your healthcare team.
9. Limitation of liability
To the maximum extent permitted by law, we will not be liable for any loss, injury, or damage arising from your use of, or reliance on, the Service. Nothing in these terms limits any rights you have under the New Zealand Consumer Guarantees Act 1993 or other laws that cannot lawfully be excluded.
10. Changes
We may update the Service and these terms from time to time. The "last updated" date shows when these terms last changed. Continuing to use the Service means you accept the current terms.
11. Governing law
These terms are governed by the laws of New Zealand, and the New Zealand courts have jurisdiction over any dispute.
